In-store kiosk

1. Access to the Service

This service, provided through the Internet Kiosk, is a free public service offered by the Bank of New Zealand ("BNZ").

Access to this service is at the discretion of BNZ, and a users access may be blocked, suspended, or terminated at any time for any reason including, but not limited to, violation of these Terms and Conditions, actions that may lead to liability for BNZ, disruption of access to other users or networks, and violations of applicable laws or regulations.

The user acknowledges that the services provided by BNZ may from time to time be unavailable due to repairs, maintenance, server or capacity issues, or telecommunications network issues. BNZ do not in any way warrant or guarantee continued access to the service.

The user must comply with any policies and directions notified or given to the user by BNZ as the occupier of any premises from which the user accesses the Internet Kiosk. The user acknowledges that BNZ shall be entitled to the benefit of these Terms and Conditions and may enforce them accordingly.

The user acknowledges that from time to time BNZ may update these Terms and Conditions and agrees to be bound by any such updates or changes.

2. User Sessions

Users may access the Internet Kiosk for up to 20 minutes at a time.

User sessions will automatically expire after 20 minutes. To ensure all users have equal access, BNZ reserves the right to end a user's access to the Internet Kiosk service after 20 minutes of use.

3. Acceptable Use of the Service

The user agrees not to use the services provided by BNZ for any unlawful purpose, to view or to post any obscenity, pornography or any other offensive or illegal material.

The user agrees not to use the services provided by BNZ to attempt to gain any unauthorised access to any part of the internet that is not available to the public or engage in any form of "hacking".

The user agrees not to use the services provided by BNZ to engage in any activity which facilitates or encourages unsolicited email including without limiting the generality of the foregoing "spamming" and "mail-bombing".

The user may not distribute information regarding the creation of and sending of Internet viruses, Trojan horses, worms, flooding, pinging, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the Internet Kiosk.

The user agrees not to engage in any activity that infringes or misappropriates the intellectual property rights of others, including patents, copyrights, trademarks, service marks, trade secrets, or any other proprietary right of any third party.

4. Abuse of Property

BNZ will not tolerate users vandalising or causing damage to Internet Kiosk hardware or software. BNZ reserves the right to remove users found abusing BNZ property from the premises where they accessed the BNZ Internet Kiosk service.

5. Limitation of Liability

Subject to any applicable legislation BNZ shall not be liable for any financial or consequential loss (including loss of profits) to the user (whether in contract, tort or otherwise) and all other such loss is hereby excluded. The collective liability (if any) of BNZ is limited to the value of the charge (if any) for any service provided via the Internet Kiosk.

At all times the user shall be responsible for protecting the privacy and confidentiality of the use and the user's information whenever using the services provided at this Internet Kiosk. BNZ does not accept any responsibility or liability for protecting the privacy and confidentiality of the user when using the services provided at this Internet Kiosk.

6. Indemnity

The user indemnifies BNZ against all costs, claims, losses, liabilities, damages and proceedings incurred by this service whether directly or indirectly as a result of any negligent act, omission or breach of these terms by the user.
