1. Consent and acceptance
1.1 Penny the Penguin is provided by Bank of New Zealand (BNZ) and is intended to be an interactive educational tool shared by caregivers or teachers with kindergarten-aged children.
1.2 Before using Penny the Penguin, you must ensure sure that you’ve obtained any necessary permissions required for anyone interacting with Penny the Penguin.
1.3 Please read these terms carefully. By downloading Penny the Penguin, and each time you use Penny the Penguin, you confirm that you have read, understand and agree to these terms in full. If you do not agree to these terms, you must not use Penny the Penguin.
1.4 BNZ may update these terms (or any part of them) at any time upon 14 days’ notice. However, where changes are made to protect the security of BNZ’s systems or to comply with a change in law, BNZ can tell you after the change has become effective. Any other updates may be notified by an electronic push message or by publishing an updated version of these terms in Penny the Penguin. By continuing to use Penny the Penguin, you will be deemed to agree to the updated terms.
2.1 BNZ may, but is not obliged to, monitor your use of Penny the Penguin and may terminate or suspend your access to Penny the Penguin at any time.
3. Intellectual property
3.1 All intellectual property rights in Penny the Penguin are owned exclusively by BNZ. Except as required to use Penny the Penguin in accordance with these terms, you cannot use any content associated with Penny the Penguin for any other purpose without BNZ’s permission.
4.1 BNZ may terminate access to, or the availability of, Penny the Penguin, or any functionality of Penny the Penguin, at any time. You may delete Penny the Penguin at any time.
5.1 You acknowledge that Penny the Penguin is provided on an “as is” and “as available” basis for general information and indicative purposes only and BNZ does not warrant that Penny the Penguin is suitable for any particular purpose. Penny the Penguin is a free interactive educational tool and BNZ doesn’t accept any liability or responsibility (including under the Consumer Guarantees Act 1993 (CGA) when you use Penny the Penguin for a business purpose, in which case you agree that the CGA doesn’t apply) for any loss you incur as a result of your use of or inability to use, or any error or omission on, Penny the Penguin.
5.2 You are responsible for any third party data charges in connection with your use of Penny the Penguin (including any charges from your mobile phone network operator for downloading, installing and using Penny the Penguin).
6. Notices from BNZ
6.1 You agree that you will receive all notices required under these terms by electronic push message.
7. Governing law
7.1 These terms are governed by the laws of New Zealand.

1. Data Collection
1.1 When you download and use Penny the Penguin, BNZ asks you for your first name only, no other personally identifiable information is requested. We do not store your name in any of our systems. It is held on your device and is therefore not sent or stored in combination with any other data on our systems that is able to be used to identify you.
1.2 When you use Penny the Penguin, Google™ Firebase Analytics provides BNZ with anonymised data relating to the version of Penny the Penguin that you are using, how many times the app has been used, and which regions the users are located. BNZ uses such data to understand how the service can be improved, to monitor usage, for security purposes, to manage any end to end user issues with Penny the Penguin and to further develop Penny the Penguin.
